Please read these terms carefully before you submit your request to access and use Maguire Jackson Online as they will be legally binding on you from the date your request is accepted. All Maguire Jackson Online Services (as defined below) are delivered strictly in accordance with these terms and no other terms will apply. Please particularly note:

  • No Maguire Jackson Online Services are provided by us. If you purchase Maguire Jackson Online Services, you contract directly with one of our partner estate agents – see more at Clause 4.4.
  • Our fees are typically non-refundable - see more at Clause 4.8.
  • Your liability under the indemnity you give us in Clause 5.9.
  • Your rights to end the agreement with us in Clause 10.
  • The cap on our liability to you in Clause 15.5.
  • 1. These terms
  • 1.1 What these terms cover. You are an individual who is either a private homeowner or a prospective purchaser. We provide a web-based platform ("Maguire Jackson Online") which, subject to these terms, provides you with access to and an opportunity to purchase property-related services via our website at the URL www.maguirejacksononline.co.uk ("Maguire Jackson Online Services"). These are the terms and conditions on which you access and use of Maguire Jackson Online and Maguire Jackson Online Services are supplied to you.
  • 1.2 Why you should read them. You must accept these terms before you access and use Maguire Jackson Online and they create a legally binding agreement between us and you. These terms tell you who we are, who Your Agent is (see below), how we will provide access to and use of Maguire Jackson Online, how Your Agent will provide Maguire Jackson Online Services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think there is a mistake in these terms, please contact us to discuss by email at support@maguirejacksononline.co.uk.
  • 2. Information about us and how to contact us
  • 2.1 Who we are. We are Maguire Jackson Limited, trading as 'Maguire Jackson Online', a company registered in England and Wales. Our company registration number is 05124751 and our registered office is at 13-15 Regent Street, Nottingham, NG1 5BS. Our registered VAT number is 844855492.
  • 2.2 How to contact us. You can contact us by telephoning our customer service team at 0121 634 1520 or by writing to us by email at support@maguirejacksononline.co.uk or by post at Maguire Jackson Online, 13-15 Regent Street, Nottingham, NG1 5BS.
  • 2.3 Who Your Agent is. Maguire Jackson Online Services will be provided to you locally by Maguire Jackson Limited ("Your Agent"), one of our partner estate agents. Your Agent is a company registered in England and Wales and Your Agent's company registration number is 05124751 and their registered office is at 13-15 Regent Street, Nottingham, NG1 5BS.
  • 2.4 How to contact Your Agent. You can contact Your Agent by telephoning its customer service team at 0121 634 1520 or by writing to Your Agent at support@maguirejacksononline.co.uk or 13-15 Regent Street, Nottingham, NG1 5BS.
  • 2.5 Our authority to act on behalf of Your Agent. We have authority to act on behalf of Your Agent including:
  • 2.5.1 binding Your Agent to a contract with you for Maguire Jackson Online Services provided such contract is on the terms set out here;
  • 2.5.2 take payment on behalf of Your Agent;
  • 2.5.3 varying your contract with Your Agent in accordance with these terms; and/or
  • 2.5.4 ending your contract with Your Agent in accordance with these terms.
  • 2.6 How you can be contacted If we or Your Agent contacts you, it will be by telephone using the number you provided to us in your request for access and use of Maguire Jackson Online or by writing to you at the email address or postal address you provided to us in your request for access and use of Maguire Jackson Online.
  • 2.7 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails or other electronic notification via Maguire Jackson Online.
  • 3. Our contract with you
  • 3.1 Access and use of Maguire Jackson Online. If you wish to access and use Maguire Jackson Online including to access Maguire Jackson Online Services to advertise and market your property for sale on Maguire Jackson Online, you must register as a user by signing-up via our website and submitting your contact details. By submitting a request for access and use of Maguire Jackson Online you represent and confirm to us:
  • 3.1.1 you are aged 18 or over;
  • 3.1.2 you are not an estate agent; and
  • 3.1.3 you have the necessary authority, power, understanding and capacity to enter into an agreement with us.
  • 3.2 Free services for purchasers. It is free to use Maguire Jackson Online to search for and view properties offered for sale and free to contact the homeowner via Maguire Jackson Online. Your use of Maguire Jackson Online is therefore undertaken entirely at your own risk, subject to the exclusions and liability limits contained in these terms.
  • 3.3 Advertising your property. To advertise your property for sale and use you must select and request to purchase one of the bundles of services (which include Maguire Jackson Online Services) as set out on our website from time to time ("Package").
  • 3.4 We only provide Maguire Jackson Online in the UK. Our website is solely for the provision of Maguire Jackson Online Services in the UK.
  • 3.5 Information or content you upload onto Maguire Jackson Online or you generate using Maguire Jackson Online. When you upload, create or publish any information or content on Maguire Jackson Online, you are entirely responsible for such content and its compliance with applicable law. You are, and such information and content is, subject to our Website Terms Of Use.
  • 3.6 Ownership of Maguire Jackson Online. We are the owners of all intellectual property rights relating to our website, Maguire Jackson Online and Maguire Jackson Online Services. You are expressly prohibited from:
  • 3.6.1 reproducing, copying, editing, transmitting, uploading and/or incorporating into any other materials our website, Maguire Jackson Online or any of Maguire Jackson Online Services; and
  • 3.6.2 removing, modifying, altering or using any trade marks, brands , logos, designs or any copy owned by us and/or Your Agent.
  • 3.7 How we will use your personal information. Any personal information and data you provide to us will be held and used by us in accordance with our Privacy Policy. For example, we will use the personal information you provide to supply access to and use of Maguire Jackson Online and to enable us and Your Agent to provide Maguire Jackson Online Services to you and to process your payment for Maguire Jackson Online Services.
  • 3.8 Website terms of use and privacy policy. Our Website Terms Of Use and Privacy Policy are incorporated into these terms and will apply and bind you. Please read them carefully and contact us by email at support@maguirejacksononline.co.uk if you have any questions about how they affect you.
  • 4. Your contract with Your Agent.
  • 4.1 Purchasing Maguire Jackson Online Services. To advertise your property for sale and use and receive Maguire Jackson Online Services you must select and request to purchase a Package. You can later purchase additional Maguire Jackson Online Services, as and when you required them. If your request is accepted, Your Agent, not us, will provide Maguire Jackson Online Services. Please note your submitting of a request and payment details to purchase a Package does not bind Your Agent to enter into a contract to provide you with Maguire Jackson Online Services.
  • 4.2 All purchases of Maguire Jackson Online Services must be made via Maguire Jackson Online. You can only purchase Maguire Jackson Online Services from Your Agent via Maguire Jackson Online.
  • 4.3 You are the owner of your property. Each time you submit a request to purchase any Maguire Jackson Online Services in relation to a property, you warrant and represent either:
  • 4.3.1 you are the legal and beneficial owner of the property with full entitlement and authority to market and sell the property; or
  • 4.3.2 you have the knowledge, authority, understanding and consent of each and all of the legal and beneficial owners and occupiers of the property to market and sell the property.
  • 4.4 How your request for Maguire Jackson Online Services is accepted. Acceptance of your request will take place when we email you on behalf of Your Agent to accept it, at which point a contract to provide Maguire Jackson Online Services will come into existence between you and Your Agent on the terms set out here.
  • 4.5 If your request for Maguire Jackson Online Services cannot be accepted. If your request is unable to be accepted, we will inform you of this and will not charge you for Maguire Jackson Online Services or refund you if a charge has been taken for those Maguire Jackson Online Services. This might be because you have not passed money laundering checks, a credit reference we have obtained for you does not meet our minimum requirements, your computer is not compatible with our website or because an agreement with you for the provision of Maguire Jackson Online Services has previously been terminated. This decision is taken in our absolute discretion.
  • 4.6 Packages are per property. Maguire Jackson Online Services can only be purchased in relation to one property and are not transferrable between properties. If you wish to advertise a second property on Maguire Jackson Online, you must purchase Maguire Jackson Online Services for that property.
  • 4.7 Your rights to make changes. If you wish to make a change to Maguire Jackson Online Services you have requested (including a change to the Package selected) please contact us (and not Your Agent) by email at support@maguirejacksononline.co.uk. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of Maguire Jackson Online Services, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If the change cannot be made or the consequences of making the change are unacceptable to you, you may want to seek to end the contract (see Clause 10 - Your rights to end the contract).
  • 4.8 If you sell your property, we cannot give you a refund. The fees you pay for the Package are non-refundable except where you end the contract in accordance with Clause 10.
  • 4.9 Maguire Jackson Online Services are only provided in the UK. Maguire Jackson Online Services can only be provided in relation to properties located in the UK.
  • 5. Advertising of properties on Maguire Jackson Online
  • 5.1 Homeowner's sole responsibility for information provided about the property. Both we and Your Agent are members of The Property Ombudsman Scheme (TPOS) and follow the TPO Code of Practice. It is however, the homeowner's sole responsibility to comply with all relevant legislation applying to the sale of your property to the purchaser including under the Consumer Protection from Unfair Regulations 2008 and any other applicable law. To list a property on Maguire Jackson Online for sale, you must first complete a property information questionnaire in relation to that property and provide an Energy Performance Certificate (EPC) for the property. The homeowner is required:
  • 5.1.1 to disclose any information of which it is aware in relation to the property, in a clear and timely fashion; and
  • 5.1.2 to take all reasonable steps to ensure all statements it makes about the property and all information (including any photographs or plans of the property) given to a purchaser or its representatives including via our website is up to date, complete, accurate and not false or misleading.
  • If you are a homeowner, you acknowledge, accept and agree:
  • 5.1.3 you must disclose anything, within your knowledge, which may affect the purchasing decision of the purchaser;
  • 5.1.4 you must immediately correct any errors or inaccuracies and/or any incomplete information identified in the listing of your property; and
  • 5.1.5 the marketing and promotion of the property cannot commence until the EPC has been provided to or ordered from us.
  • 5.2 Purchaser's sole responsibility to accurately verify information provided about the property. If you are a purchaser, you acknowledge, accept and agree:
  • 5.2.1 we cannot guarantee the accuracy, completeness or suitability of any of the information, content, imagery, photography and/or other materials uploaded onto Maguire Jackson Online or generated by the homeowner;
  • 5.2.2 we are unable to independently verify and/or confirm the accuracy of that information, content and/or materials;
  • 5.2.3 we do not accept any liability for any reliance placed on that information, content and/or materials;
  • 5.2.4 it is your responsibility to satisfy yourself of the veracity, accuracy, completeness and suitability of any property descriptions and/or information on Maguire Jackson Online; and
  • 5.2.5 we have no control over, do not guarantee and shall not be responsible for the quality, safety or legality of any properties listed on Maguire Jackson Online.
  • 5.3 Removal of information regarding a property. If any person informs us the information provided by a homeowner on our website is not up to date or accurate, false or misleading we will conduct an investigation and shall be entitled to remove or take down the any such information at our entire discretion with no liability to the homeowner.
  • 5.4 Property purchase price. Although we can advise on house valuations for properties similar to your property from publicly available data, it is your responsibility to determine the price at which your property will be marketed for sale.
  • 5.5 Listing on third party websites. If you are a homeowner, as part of Maguire Jackson Online Services your property will be listed for sale on the third party websites Rightmove, Zoopla and Primelocation. As we have no control over these third party websites, we cannot guarantee the functionality of such websites or the accuracy of your listing on those websites. As a homeowner, it is your responsibility to verify the accuracy of your listing on those third party websites and the availability of your property on such third party websites.
  • 5.6 Duration of listing. After receiving payment and the information required for the property under these terms, your property will be listed on Maguire Jackson Online. Your property will remain listed for the period of time associated with the Package you purchased, as stated on our website. For example, if you purchased the 'Pay as you go' Package, your property will be listed for each month you pay the monthly fee for that Package (see Clause 14.2).
  • 5.7 Removal from listing. You can inform us that you wish us to stop marketing your property by unticking the box to signify your wish to stop us marketing the property. In any event, at the end of the Package's duration, we may immediately and without notice remove the property from being visible and searchable to purchasers on Maguire Jackson Online.
  • 5.8 Infringement of a person's intellectual property rights. If any person informs us any information on our website provided by a homeowner (such as property descriptions, photographs, plans of the property or EPC reports) infringes or potentially infringes that person's intellectual property rights we will conduct an investigation and may immediately take down the complained of information at our entire discretion. If you as a homeowner are notified of or identify any use of a third party's intellectual property rights which you do not have permission to use, you must notify us immediately by email at support@maguirejacksononline.co.uk and remove it from our website it immediately.
  • 5.9 Indemnity for misrepresentation or infringement of a person's intellectual property rights. You shall indemnify us against all liabilities, costs, expenses, damages and losses suffered or incurred by us as a result of or in connection with any claim brought against us for:
  • 5.9.1 misrepresentation arising out of, or in connection with, your listing of your property including (but not limited to) the provision of false, incorrect or misleading information about the property;
  • 5.9.2 your actual or alleged infringement of a third party's intellectual property rights or similar rights; and/or
  • 5.9.3 your breach of applicable law and/or our breach of applicable law arising out of, or in connection with, your actions or omissions.
  • 6. Boards
  • 6.1 'For sale' board. If the provision of a board is part of Maguire Jackson Online Services package you selected or you have purchased it in addition to the package you selected, you shall be sent a 'for sale' board for you to erect at your property.
  • 6.2 Delivery. The board will be delivered to you by post to the postal address you provide on sign-up as soon as reasonably possible and in any event within 30 days after the day on which your request for the provision of this Maguire Jackson Online Service is accepted.
  • 6.3 Erecting our board. You are responsible for erecting and maintaining the board in accordance with applicable law. You shall erect the board as sent to you and shall not adapt, deface and/or modify the board.
  • 6.4 You must only display our board. The Town & Country Planning Regulations permit the display of only one 'for sale' board. You agree not to display any other 'for sale' board at the property whilst you are listing that property on Maguire Jackson Online.
  • 6.5 We have no responsibility for loss or damage. Once you have received the board, the board will belong to you and we do not accept any responsibility for any damage or loss suffered in connection with the use or display of the board as set out in Clause 13.2.
  • 6.6 When the costs of return of the board will be paid. The costs of return of the board will be paid:
  • 6.6.1 if its faulty or misdescribed (unless this is due to information you have provided to us); or
  • 6.6.2 if you are ending the contract because we have told you of an upcoming change to the board or these terms, an error in pricing or description, a delay in delivery due to events outside our reasonable control or because you have a legal right to do so as a result of something we have done wrong.
  • In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.
  • 7. Services provided whilst your property remains listed
  • 7.1 Direct interaction. Potential purchasers of the property should contact the homeowner directly via Maguire Jackson Online or the websites of our selected third party partners. We have no control over, do not guarantee and shall not be responsible for the sale of a property and/or any interaction between users of Maguire Jackson Online.
  • 7.2 Viewings. Viewings can be requested by the potential purchaser via Maguire Jackson Online and once confirmed by the homeowner, a confirmation email will be sent to both parties detailing the property address, the viewing time and date and the parties respective contact details. It is your responsibility to manage viewings and we are not responsible for ensuring either party attends at the viewing at the arranged time and date. Unless professional viewings are purchased as a Maguire Jackson Online Service, we have no control over, do not guarantee and shall not be responsible for the conduct of viewings. We shall have no liability for any acts or omissions of any person during any viewings of your property and we recommend you have appropriate insurance, safeguards and measures in place in relation to viewings.
  • 7.3 Offers. We will, via Maguire Jackson Online, promptly and automatically notify the homeowner of a property all offers we receive via Maguire Jackson Online from potential purchaser at any time until we are notified of exchange of a purchase, unless the offer is of an amount or type the homeowner has specifically instructed us not to pass on. We have no control over, do not guarantee and shall not be responsible for the suitability or ability to pay of any prospective purchaser making an offer or whether any prospective purchaser will complete a relevant transaction and/or has necessary funds to complete such transaction.
  • 7.4 Personal interest. If you are a homeowner, we will inform you as soon as we become aware of anyone making an offer for your property who is in any way connected with us, such as being one of our employees or contractors or their family members. In the event you suspect or become aware of any such personal interest, you must notify us immediately and we will make such necessary enquiries to provide you with written notification of the nature of the personal interest (if any).
  • 7.5 Memorandum of sale. Once the parties have informed us they have agreed a sale, we will prepare, using the information you provided to us via Maguire Jackson Online, a memorandum of sale and send it to the parties by email along with any details provided to us of the solicitors or licensed conveyancers acting for either parties.
  • 8. Our rights to make changes
  • 8.1 Minor changes to Maguire Jackson Online Services. We may change Maguire Jackson Online Services:
  • 8.1.1 to reflect changes in relevant laws and regulatory requirements (if so we will endeavour to explain the anticipated practical effects of such changes at the time of change); and
  • 8.1.2 to implement minor technical adjustments and improvements, for example to address a security breach and/or threat.
  • Unless we let you know otherwise, these changes will not affect your use of Maguire Jackson Online Services.
  • 8.2 More significant changes to Maguire Jackson Online Services and these terms. We may make more significant changes to Maguire Jackson Online Services which affect your use of Maguire Jackson Online Services, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any Maguire Jackson Online Services paid for but not received.
  • 9. Providing Maguire Jackson Online Services
  • 9.1 When Your Agent will provide Maguire Jackson Online Services. Commencement of the provision of Maguire Jackson Online Services is subject to our acceptance of your request in accordance with Clause 4.4 and the payment in full and cleared funds of the correct fees in relation to the type Package and any additional Maguire Jackson Online Services selected.
  • 9.2 Duration of Maguire Jackson Online Services. Your Agent will supply Maguire Jackson Online Services to you until the subscription for the Package you purchased expires or you end the contract as described in Clause 10 or we end the contract by written notice to you as described in Clause 12.
  • 9.3 Professional photography, professional floor plan, professional video clip, accompanied viewings and EPC. If any of professional photography, professional floor plan, professional video clip, accompanied viewings or EPC are part of the Package you purchased, or you purchase any of them in addition to the Package you originally purchased in relation to your property, Your Agent will arrange for an appropriate professional to contact you to arrange a mutually suitable time to carry out the provision of those services at your property. If you do not allow Your Agent or the professional to access to your property to perform the services as arranged (and you do not have a suitable reason for this) you may be charged any additional costs incurred as a result. If, despite reasonable efforts, you are unable to be contacted or access to your property cannot be re-arranged, we may end the contract and Clause 12.3 will apply.
  • 9.4 No guarantee. Neither we nor Your Agent give any guarantee that any of Maguire Jackson Online Services you may purchase will have any particular result or outcome, for example, that surveys will give a positive report or that the placing of advertising will lead to any responses from purchasers and/or other third parties.
  • 9.5 We are not responsible for delays outside our control. If Your Agent's supply of Maguire Jackson Online Services is delayed by an event outside its control then you will be contacted as soon as possible to let you know and the steps to be taken to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for Maguire Jackson Online Services (if any) you have paid for but not received.
  • 9.6 What will happen if you do not provide required information. We and Your Agent need certain information from you so you can use Maguire Jackson Online and/or Maguire Jackson Online Services can be supplied to you, for example your contact details, payment details and, if you are a homeowner, certain details of your property in accordance with Clause 5.1. We will request this from you when you request Maguire Jackson Online Services but we may contact you from time to time to request more information. If you do not provide us with this information within a reasonable time of us asking for it, or if you provide incomplete or incorrect information, we may end the contract (Clause 12.3 will apply) and neither we nor Your Agent will be responsible for supplying Maguire Jackson Online Services late or not supplying any part of them if this is caused by you not providing the information needed within a reasonable time it being requested.
  • 9.7 Reasons why access to or use of Maguire Jackson Online and/or the supply of Maguire Jackson Online Services to you may be suspended. Access to and use of Maguire Jackson Online or the supply of Maguire Jackson Online Services to you may be suspended:
  • 9.7.1 to deal with technical problems or make minor technical changes to Maguire Jackson Online;
  • 9.7.2 to update Maguire Jackson Online Services to reflect changes in relevant laws and regulatory requirements;
  • 9.7.3 to make changes to Maguire Jackson Online Services as requested by you or notified by us to you (see Clause 8);
  • 9.7.4 if you are in breach of these terms; or
  • 9.7.1 if an event occurs beyond our reasonable control which affects Maguire Jackson Online and/or Maguire Jackson Online Services.
  • 9.8 Your rights if access to or use of Maguire Jackson Online and/or the supply of Maguire Jackson Online Services to you is suspended. We will contact you in advance to tell you access to or use of Maguire Jackson Online and/or the supply of Maguire Jackson Online Services to you is to be suspended, unless the problem is unforeseen, urgent or an emergency. If access to or use of Maguire Jackson Online and/or Maguire Jackson Online Services have to be suspended for longer than two consecutive days in any calendar month we will adjust the price so you do not pay for Maguire Jackson Online Services while they are suspended. You may contact us to end the contract for access to or use of Maguire Jackson Online and/or supply of Maguire Jackson Online Services if they are suspended, or tell you we are going to suspend it, in each case for a period of more than two consecutive days in any calendar month and we will refund any sums you have paid in advance for Maguire Jackson Online Services in respect of the period after you end the contract.
  • 9.9 Access to or use of Maguire Jackson Online and/or Maguire Jackson Online Services may also be suspended if you do not pay. If you do not pay for Maguire Jackson Online Services when you are supposed to (see Clause 14.5) and you still do not make payment within 24 hours of us reminding you payment is due, access to or use of Maguire Jackson Online and/or the supply of Maguire Jackson Online Services may be suspended until you have paid us the outstanding amounts. You will not be charged for Maguire Jackson Online Services during the period for which they are suspended. As well as suspension of Maguire Jackson Online Services we can also charge you interest on your overdue payments (see Clause 14.6).
  • 10. Your rights to end the contract
  • 10.1 Our contract and Your Agent's contract are interdependent. Ending your contract with us will also automatically and immediately end your contract with Your Agent. Similarly, ending your contract with Your Agent will also end automatically and immediately your contract with us.
  • 10.2 You can always end your contract. Your rights to end both the contract with us and the contract with Your Agent will depend on Maguire Jackson Online Services purchased, whether there is anything wrong with them, how we are performing, how Your Agent is performing and when you decide to end the contract:
  • 10.2.1 If Maguire Jackson Online Services purchased are misdescribed you may have a legal right to end the contract (or to get Maguire Jackson Online Services re-performed or to get some or all of your money back), see Clause 13;
  • 10.2.2 If you want to end the contract with us because of something we have done or have told you we are going to do, see Clause 10.3;
  • 10.2.3 If you want to end the contract with Your Agent because of something Your Agent has done or have told you it is going to do, see Clause 10.3;
  • 10.2.4 If you have just changed your mind about Maguire Jackson Online Services, see Clause 10.4.You may be able to get a refund if you are within the cooling-off period but this may be subject to deductions for services already provided and you will have to pay the costs of return of any 'for sale' board supplied to you; and
  • 10.2.5 If you have purchased a 'Pay as you go' Package and you no longer wish to subscribe to Maguire Jackson Online Services, see Clause 14.2.
  • 10.3 Ending the contract because of something we or Your Agent have done or are going to do. If you are ending a contract for a reason set out below, the contract will end immediately and we will refund you in full for any Maguire Jackson Online Services which have not been provided and you may also be entitled to compensation. The reasons are:
  • 10.3.1 you have been told about an upcoming change to Maguire Jackson Online Services or these terms which you do not agree to (see Clause 8.2);
  • 10.3.2 you have been told about an error in the description of Maguire Jackson Online Services you have requested and you do not wish to proceed;
  • 10.3.3 there is a risk supply of Maguire Jackson Online Services may be significantly delayed because of events outside our control and/or the control of Your Agent;
  • 10.3.4 Maguire Jackson Online and/or Maguire Jackson Online Services have been suspended for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than two consecutive days in any calendar month; or
  • 10.3.5 you have a legal right to end the contract due to our error.
  • 10.4 Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most services purchased online you have a legal right to change your mind within 14 days and receive a refund.
  • 10.5 When you don't have the right to change your mind. You consent to the supply of our services and any Maguire Jackson Online Services purchased within the cancellation 14 day period but please be aware this might affect any refund due to you on cancellation. You do not have a right to change your mind in respect of Maguire Jackson Online Services, once Maguire Jackson Online Services have been completed (e.g. you sell your property), even if the cancellation period is still running.
  • 10.6 How long do I have to change my mind? You have 14 days after the day we email you to confirm we accept your request for Maguire Jackson Online Services. However, once we have completed the services you cannot change your mind, even if the 14 day cancellation period has not yet expired. If you cancel after we have started the services, you must pay us for the services provided up until the time you tell us you have changed your mind.
  • 11. How to end the contract with us (including if you have changed your mind)
  • 11.1 Tell us you want to end the contract. To end the contract with us, please let us know by doing one of the following:
  • 11.1.1 Phone or email. Call customer services on 0121 634 1520 or email us at support@maguirejacksononline.co.uk. Please provide your name, home address, details of the request and, where available, your phone number and email address.
  • 11.1.2 Online. Complete the cancellation form on our website.
  • 11.1.3 By post. Print off the cancellation form and complete it before posting it to us at the address on the form. Or simply write to us at address, including details of what Maguire Jackson Online Services purchased, when you requested or received Maguire Jackson Online Services and your name and address.
  • 11.2 Deductions from refunds if you are exercising your right to change your mind. You acknowledge we are performing services and Maguire Jackson Online Services may be being performed during the cancellation period. If you are exercising your right to change your mind, we may deduct from any refund the fee paid for the supply of Maguire Jackson Online Services for the period for which they were supplied, ending with the time when you told us you had changed your mind. The amount will be in proportion to what has been supplied, in comparison with the full coverage of the contract. Where there is a refund payable to you under these terms, we will refund you the price you paid for Maguire Jackson Online Services including delivery costs, by the method you used for payment.
  • 11.3 When your refund will be made. We will make any refunds due to you (if any) as soon as reasonably possible. If you are exercising your right to change your mind then your refund will be made within 14 days of your telling us you have changed your mind.
  • 12. Our rights to end the contract
  • 12.1 Our contract and Your Agent's contract are interdependent. If we end your contract with us, your contract with Your Agent will also be ended automatically and immediately. Similarly, if your contract with Your Agent is ended, your contract with us will also be ended automatically and immediately.
  • 12.2 We may end the contract if you break it. We may end the contract for access to or use of Maguire Jackson Online and/or Maguire Jackson Online Services at any time by writing to you if:
  • 12.2.1 you do not make any payment when it is due and you still do not make payment within 24 hours of us reminding you payment is due;
  • 12.2.2 you do not, within a reasonable time of us asking for it, provide us with information necessary for us to provide access to or use of Maguire Jackson Online and/or Maguire Jackson Online Services, see Clause 9.6;
  • 12.2.3 you do not, within a reasonable time, allow Maguire Jackson Online Services to be delivered to you;
  • 12.2.4 you do not, within a reasonable time, allow us access to your premises to supply certain Maguire Jackson Online Services;
  • 12.2.5 you breach Clause 5.8 regarding third parties' intellectual property rights; or
  • 12.2.6 you undertake an activity which is not in compliance with applicable law.
  • 12.3 Retention of fees you break the contract. If we end the contract in the situations set out in Clause 12.2 we shall be entitled to retain any amounts you have paid for Maguire Jackson Online Services without limitation to our legal rights and remedies.
  • 12.4 We may withdraw access to or use of Maguire Jackson Online and/or Maguire Jackson Online Services. We may write to you to let you know we are going to stop providing access to or use of Maguire Jackson Online and/or Maguire Jackson Online Services. We will let you know at least 7 days in advance of our stopping access to or use of Maguire Jackson Online and/or the supply of Maguire Jackson Online Services and will refund any sums you have paid in advance for Maguire Jackson Online Services which will not be provided.
  • 13. If there is a problem with Maguire Jackson Online Services
  • 13.1 How to tell us about problems. Both we and Your Agent are members of The Property Ombudsman and comply with The Property Ombudsman' code of practice. If you have any questions or complaints about Maguire Jackson Online or Maguire Jackson Online Services, please contact us. You can telephone our customer service team at 0121 634 1520 or by writing to us at support@maguirejacksononline.co.uk or 13-15 Regent Street, Nottingham, NG1 5BS. Any complaints will be treated fairly and in accordance with The Property Ombudsman's guidelines.
  • 13.2 Summary of your legal rights. We are under a legal duty to supply access and use of Maguire Jackson Online in conformity with this contract and Your Agent is under a legal duty to supply Maguire Jackson Online Services which are in conformity with this contract. See the box below for a summary of your key legal rights in relation to Maguire Jackson Online and/or Maguire Jackson Online Services. Nothing in these terms will affect your legal rights.
  • Summary of your key legal rights

    This is a summary of your key legal rights. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06.

    As your contract to access and use Maguire Jackson Online and your contract for Maguire Jackson Online Services are contracts for services, the Consumer Rights Act 2015 says:

  • you can ask us to repeat or fix a service if it's not carried out with reasonable care and skill, or get some money back if we can't fix it.

  • if you haven't agreed a price beforehand, what you're asked to pay must be reasonable.

  • if you haven't agreed a time beforehand, it must be carried out within a reasonable time.

  • See also Exercising your right to change your mind (Consumer Contracts Regulations 2013).

    If you have purchased a 'for sale' board as part of Maguire Jackson Online Services, the Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

  • up to 30 days: if your goods are faulty, then you can get an immediate refund.

  • up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.

  • up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

  • 14. Price and payment
  • 14.1 Where to find the price for Maguire Jackson Online Services. If you are a homeowner, the price of Maguire Jackson Online Services (which includes VAT) will be the price indicated on our website from time to time. The price of Maguire Jackson Online Services is per property listed on our website. We take all reasonable care to ensure the price of Maguire Jackson Online Services advised to you is correct. If you are a purchaser, we shall supply Maguire Jackson Online Services to you for no charge. You are required to pay the full price up front for the Package you select even if you do not use all of Maguire Jackson Online Services included in that Package.
  • 14.2 Pay as you go Package subscription. If you select the 'Pay as you go' Package, you are purchasing Maguire Jackson Online Services on a monthly subscription basis and you agree we will automatically renew those Maguire Jackson Online Service monthly and charge you for such Maguire Jackson Online Services until:
  • 14.2.1 you provide us with written notice of termination to be received two weeks' before the end of the month, in which case Maguire Jackson Online Services will cease at the end of the month (if you provide us with written notice less than two weeks before the end of the month, you will also be charged for the 'Pay as you go' Package fee for the next month); or
  • 14.2.2 the agreement between us is terminated in accordance with these terms.
  • 14.3 Missing appointments for photographs, floor plans, video clips or accompanied viewings. If you are a homeowner and have purchased a Package which includes the provision of photography, floor plan, video clips and/or accompanied viewings to the property, if you fail to attend at the property at the scheduled appointment time, we reserve the right to charge you for the re-scheduled appointment in addition to the charges for the original appointment. Any charges you may have already paid for the original appointment will not be refunded. Our additional charges will vary depending on the size and layout of the property and your requirements for photographs/video clips.
  • 14.4 We will pass on changes in the rate of VAT. If the rate of VAT changes between your request date and the date we supply Maguire Jackson Online Services, we will adjust the rate of VAT you pay, unless you have already paid for Maguire Jackson Online Services in full before the change in the rate of VAT takes effect.
  • 14.5 When you must pay and how you must pay. You must pay for Maguire Jackson Online Services at the time you purchase them in full upfront before we start providing those Maguire Jackson Online Services. We accept payment with most generally accepted credit and debit cards.
  • 14.6 We can charge interest if you pay late. Without limitation to our other legal rights and remedies, if you do not make any payment to us by the due date we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of the Bank of England from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.
  • 15. Our responsibility for loss or damage suffered by you
  • 15.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms in relation to Maguire Jackson Online, we are responsible for loss or damage you suffer is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage which is not foreseeable. Loss or damage is foreseeable if either it is obvious it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you drew it to our attention when requesting access to and use of Maguire Jackson Online.
  • 15.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for:
  • 15.2.1 death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
  • 15.2.2 fraud or fraudulent misrepresentation; or
  • 15.2.3 breach of your legal rights in relation to Maguire Jackson Online as summarised at Clause 13.2.
  • 15.3 We are not liable for business losses. We only supply Maguire Jackson Online for domestic and private use. If you use Maguire Jackson Online for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • 15.4 We are not liable for losses cause by Your Agent. Where loss has been caused to you by Your Agent, please see Clause 16 below.
  • 15.5 Our liability cap. We will, subject to the rest of this Clause 15 and these terms, only be liable to you up to an aggregate total of £1,000 per property listed on Maguire Jackson Online.
  • 16. Your Agent's responsibility for loss or damage suffered by you
  • 16.1 Your Agent is responsible to you for foreseeable loss and damage caused by it. If Your Agent fails to comply with these terms in relation to Maguire Jackson Online Services, Your Agent is responsible for loss or damage you suffer is a foreseeable result of its breaking this contract or Your Agent failing to use reasonable care and skill, but Your Agent is not responsible for any loss or damage which is not foreseeable. Loss or damage is foreseeable if either it is obvious it will happen or if, at the time the contract was made, both Your Agent and you knew it might happen, for example, if you drew it to our attention when requesting Maguire Jackson Online Services.
  • 16.2 Your Agent does not exclude or limit in any way its liability to you where it would be unlawful to do so. This includes liability for:
  • 16.2.1 death or personal injury caused by our negligence or the negligence of Your Agent's employees, agents or subcontractors;
  • 16.2.2 fraud or fraudulent misrepresentation; or
  • 16.2.3 breach of your legal rights in relation to Maguire Jackson Online Services as summarised at Clause 13.2.
  • 16.3 Your Agent is not liable for business losses. Your Agent only supplies Maguire Jackson Online Services for domestic and private use. If you use Maguire Jackson Online Services for any commercial, business or re-sale purpose Your Agent will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • 16.4 Our liability cap. Your Agent will, subject to the rest of this Clause 15 and these terms, only be liable to you up to an aggregate total of £5,000 per property for which Maguire Jackson Online Services have been purchased.
  • 17. Other important terms
  • 17.1 We may transfer this agreement to someone else. We may transfer our rights and obligations (or those of Your Agent) under these terms to another organisation. We will always tell you in writing if this happens and we will ensure the transfer will not affect your rights under the contract.
  • 17.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. We may not agree if Maguire Jackson Online Services are to be supplied in relation to a different property than the one originally listed.
  • 17.3 Nobody else has any rights under this contract. This contract is between you, us and Your Agent. No other person shall have any rights to enforce any of its terms including under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
  • 17.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  • 17.5 Even if we and/or Your Agent delays in enforcing this contract, it can still be enforced later. If we and/or Your Agent do not insist immediately you do anything you are required to do under these terms, or if we and/or Your Agent delay in taking steps against you in respect of your breaking this contract, will not mean you do not have to do those things and it will not prevent us and/or Your Agent taking steps against you at a later date. For example, if you do not make a payment by the due date and we do not chase you but we continue to provide Maguire Jackson Online Services, we can still require you to make the payment at a later date.
  • 17.6 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of Maguire Jackson Online and/or Maguire Jackson Online Services in the English courts. If you live in Scotland you can bring legal proceedings in respect of Maguire Jackson Online Services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of Maguire Jackson Online Services in either the Northern Irish or the English courts.
  • 17.7 The Property Ombudsman's alternative dispute resolution service. Alternative dispute resolution is a process where an independent body, such as The Property Ombudsman considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact The Property Ombudsman. You can submit a complaint to The Property Ombudsman via their website at www.tpos.co.uk. The Property Ombudsman will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings. In addition, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform.
